Terms of Service

These terms are the agreement between you and Griffin Budreau, sole proprietor, doing business as PaiThai(“PaiThai”, “we”) when you use the PaiThai apps and websites (paithai.app and app.paithai.app). Short version: be a normal human learner, pay for what you subscribe to through the store you bought it from, don’t steal the course, and understand that AI feedback is a study aid, not a diploma. The long version follows.

1. Who can use PaiThai

You must be at least 13 years oldto create an account. By creating one, you confirm you are. You’re responsible for keeping your sign-in credentials to yourself and for what happens under your account. One account per person; accounts are yours alone and can’t be sold or shared.

You can also use PaiThai in guest mode, with no account — your progress stays on your device (and can’t be recovered if the device is lost or the app is uninstalled).

2. Beta period

PaiThai is currently in beta. That means: features may change or break, content is still being expanded, access to some surfaces (like the web app) may be invite-only, and complimentary premium access granted to testers is a courtesy we may end when the beta ends. We’ll always try to be graceful about it, but during beta, stability isn’t promised.

3. Subscriptions and billing

  • How you pay: subscriptions are purchased through the Apple App Store, Google Play, or (on the web) Stripe. Your payment details go to them, not us — see the Privacy Policy.
  • Auto-renewal: subscriptions renew automatically until you cancel. Cancel any time in your App Store / Google Play subscription settings, or (for web purchases) through the billing portal we link from your account. Cancelling stops the next renewal; you keep access until the end of the period you already paid for.
  • Prices:the price shown at purchase in your store is the price you pay. Displayed prices in the app are informational; the store’s checkout is authoritative. If we change prices, the change applies from your next renewal and the store will notify you per its own rules.
  • Free trials:where offered (for example on the annual plan), you can cancel during the trial and pay nothing. A trial converts to a paid subscription if you don’t cancel before it ends.
  • Refunds: purchases through Apple or Google follow theirrefund policies and are requested from them directly (we literally cannot issue an App Store refund). For web purchases, contact us and we’ll handle it reasonably. Nothing here limits refund rights that consumer law in your country guarantees you.
  • Free tier: parts of the course are free, and stay free. Free accounts have usage limits on the AI-powered features (see §5).
  • Promotions:we may run promotional offers (for example, founding-tester perks). Promotional access is what the promotion says it is, and doesn’t renew as a paid entitlement.

4. Your license to the course — and ours to your contributions

The course — lessons, stories, guidebooks, vocabulary, audio, artwork, and the app itself — belongs to PaiThai (or its licensors). We grant you a personal, non-transferable, non-commercial license to use it for learning Thai. You may not copy, scrape, extract, republish, or resell the content, build a competing dataset or course from it, or use automated tools to bulk-download it. (Studying hard is encouraged; harvesting is not.)

Things you submit — writing-practice answers, feedback, support messages — remain yours, but you grant us the right to process them to run the service (grading your answer, fixing the bug you reported). If you send us suggestions or feedback about the product, we can use them freely, without owing you anything — that’s the deal for keeping feedback simple.

5. AI features and fair use

Pronunciation checks and free-response writing feedback are powered by third-party AI services (see the Privacy Policy for who). Two things to understand:

  • AI feedback is a study aid, not an authority. Scores and feedback are automated estimates and can be wrong in both directions. They are not a certification, a professional language assessment, or a guarantee of your level. Course level names (A1–B2) describe our curriculum’s targets, not an accredited exam result.
  • Fair-use limits apply. Free accounts get a daily allowance of AI checks; premium accounts get generous limits designed so that no honest learner ever hits them. The limits exist to stop abuse (scripted or bulk use), and we may adjust them for that purpose. Attempting to circumvent them is a violation of these terms.

6. Educational content only — not professional advice

PaiThai teaches language. Some content uses professional settings (for example, healthcare, legal, or business vocabulary) as its subject matter. None of it is medical, legal, financial, immigration, or religious advice, and it must not be relied on as such. If a lesson teaches you the Thai word for “contract”, that is vocabulary, not counsel.

7. Acceptable use

Don’t: break the law with the service; probe, overload, or attack our systems; access other users’ data; circumvent usage limits, entitlements, or the paywall; misrepresent your identity to us; or harass others through any surface that reaches humans (display names on the leaderboard, support channels). We may suspend or terminate accounts that do — with a warning where reasonable, without one where the conduct is severe.

8. Ending things

You can stop any time: cancel renewals in your store, and delete your account in-app (Profile → Delete account — it’s immediate and irreversible). We can suspend or terminate accounts for violations of these terms, and we can discontinue the service or features of it; if we ever discontinued paid service entirely, we’d handle remaining paid periods fairly (refund or equivalent).

9. Disclaimers and limits on liability

The service is provided “as is”. To the maximum extent the law allows: we disclaim implied warranties (merchantability, fitness for a particular purpose, non-infringement); we don’t warrant uninterrupted or error-free operation; and our total liability to you for any claim connected to the service is capped at the greater of the amount you paid us in the 12 months before the claim or US $20. We are not liable for indirect, incidental, or consequential damages (lost profits, lost data, substitute services). Some jurisdictions don’t allow some of these limits — where that’s you, these clauses apply only as far as that law permits, and nothing here overrides consumer rights that can’t be waived.

10. Governing law and disputes

These terms are governed by the laws of the State of Florida, USA, excluding its conflict-of-law rules. Disputes go to the courts of that state, unless required consumer law gives you the right to your local courts.

11. Changes to these terms

We may update these terms as the product evolves. For material changes, we’ll update the date above and notify you in the app before they take effect; continuing to use PaiThai after that is acceptance. If you don’t agree, stop using the service and (if you subscribed) cancel renewal.

12. App-store extras

If you got the app from Apple’s App Store or Google Play, their standard terms also apply to the download itself, and those companies are not responsible for the app or these terms — the usual store boilerplate both platforms require.
